Terms and conditions

This is the English reading version of our German terms and conditions. The German text is the legally binding one.

§ 1 Scope

These terms and conditions apply to all contracts between Lang & Länger GmbH, Hafengasse 14, 89073 Ulm, Germany (“we”) and its customers for the purchase of clothing through this online shop and in the shop itself. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). We do not accept differing terms of the customer unless we have expressly agreed to them in writing.

§ 2 Conclusion of contract

The presentation of goods in the online shop is not a legally binding offer but a non-binding invitation to order. By clicking the order button you make a binding offer to buy the goods in your cart. We confirm receipt of the order by email without delay; this acknowledgement is not yet an acceptance. The contract comes into being once we expressly declare acceptance or dispatch the goods.

Before submitting the order you can review your entries in the order summary and correct them using the “Edit” button. We store the contract text and send it to you together with these terms in text form. The contract is concluded in German or English, as you choose.

§ 3 Measurements and fit

Our goods are not described or sold in standard clothing sizes but in centimetres. What counts are the finished garment measurements stated on the relevant product page (among others inseam, sleeve length, waist or chest girth, total length). These are figures from current production; manufacturing deviations of up to one centimetre are customary in the trade and do not constitute a defect. For unwashed denim we point out separately that the length may change by about one centimetre after the first wash; this is already allowed for in the stated inseam.

Body measurements you provide during the order process serve solely for our internal check before dispatch. They are voluntary and do not constitute a warranty of any particular fit.

§ 4 Prices and shipping costs

All prices are final prices in euros and include statutory VAT. The shipping costs shown during the order process are added. Within Germany we ship free of charge from an order value of €120; below that a flat shipping charge of €4.90 applies. The rates shown during the order process apply for deliveries to Austria, Switzerland and the Netherlands. Import duties may apply in addition for deliveries to Switzerland and are borne by you.

§ 5 Payment

The payment methods stated in the order process are available: purchase on account with payment due 14 days from the invoice date, card payment, SEPA direct debit, and cash on collection in the shop. In the event of default we charge default interest at the statutory rate. You have a right of retention only insofar as your counterclaims arise from the same contractual relationship.

§ 6 Delivery and retention of title

Goods in stock are dispatched within two working days of the contract being concluded. Delivery within Germany then normally takes one to three working days. If an ordered item is unavailable in the requested length we will inform you without delay and refund any payment already made immediately.

The goods remain our property until paid for in full. For consumers the risk of accidental loss passes to you only on handover of the goods.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days. Please see our withdrawal policy for the details, including the model withdrawal form. We voluntarily bear the cost of returns within Germany and provide you with a return label for this purpose.

§ 8 Warranty

Statutory liability for defects applies. The limitation period for claims relating to defects in new goods is two years from delivery. Customary variation in the colour and texture of natural materials, and the patina that develops in use on garment-dyed and unwashed fabrics, do not constitute a defect.

§ 9 Alteration service

For goods bought in our shop we alter hem and sleeve lengths once free of charge within twelve months of purchase, provided the alteration does not exceed three centimetres and the cut permits it. The alteration service is a voluntary additional service and does not affect statutory warranty rights. Altered goods can no longer be withdrawn from where the alteration was made at your express request and the garment was thereby clearly tailored to your personal requirements.

§ 10 Liability

We are liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. In the event of slightly negligent breach of a material contractual obligation our liability is limited to the foreseeable damage typical of the contract. Liability is otherwise excluded. Claims under the German Product Liability Act remain unaffected.

§ 11 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected. Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected.

§ 13 Note on this website

This website is a demonstration site. The ordering process stops before payment, no contract of sale is concluded and no goods are dispatched. The terms above are drafted as a model for the business described.
